<HTML>Clearly with no proper markings, armed and carrying illegal cargo this can not be classified as a hospital ship. The SU commander did no more than what a USN Sub skipper would have done if presented with a similar target at that time in the Pacific. The rules for Hospital ships at the time were very clear.
Interestingly the Germans abused the hospital ship tag in the Mediteranean too by using them for logistics and communications to the Afrika Corps.
However, following all the rules in the Pacific didnt make you safe as the Hospital ship Centaur found out when torpedoed by a IJN sub in the south pacific with considerable loss of life.</HTML>
