Hi JerseyDavid,
Collateral damage is too mild a term for it. There were men clinging to the wreckage. What he did was the same as sinking a lifeboat and then claiming that the men in it were just "collateral damage". Though it was his intention to sink the wreckage He crossed a line and he spent a considerable amount of time doing it. They stayed in the area and systematically fired on the wreckage and even used handgrenades. Eck was tried by a court and executed for it.
On another note, when Eck's boat was abandoned, British planes fired on it and at least one of the men in the water was hit. They too could claim they were machine-gunned in the water. Only the man firing the guns knows what he was aiming at but it was neither German or British policy to shoot men in the water. The U-boat was a legitimate target, wreckage with men clinging to it wasn't though.
