Smells fishy to me?

This was posted on a subsim fansite i was reading today.
"Another story is of Günther Heinrich, commander of U 960, peering through his periscope at a troop transport filled with American soldiers on their way to Europe. He said he knew the war was lost and did not torpedo the ship even though he was in a very good position to do so. Heinrich said that he could see the soldiers smoking at the railings he was so close. Heinrich felt that it would be of no use to kill so many men when the situation was already decided. The interesting note about this is the invasion of Normandy had yet to occur!! "
Bearing in mind what happened to Hirsacker in U-572' sounds very fishy to me especially as pre D-Day.
Anyway can anyone enlighten me on this story?
