U 35 and U 38 were both German controlled and crewed submarines that flew the Austrian flag for convience. Germany and Italy were not yet at war though Austria and Italy were. The Germans felt obligated to aid their Italian allies and did so by sinking Italian vessels when they encountered them. Of course, to do so they pretended to be Austrian (hence the flag) and were very nominally listed in the Austrian naval register (hence the Austrian listing on these boats). The German U 35 was also the Austrian U 35 and the German U 38 was also the Austrian U 38.

The same thing happened with UC 12 -- while she was listed in the Austrian naval register and even had an Austrian officer on board, she was still essentially a German submarine.

Of course, Austria got all the protests about the actions of these vessels, when in fact there is little they could do about it.
