It was U 39, right.

09.25h gun-fight with french S/S L'Aube, 1589 g.r.t., position 35°38'N-07°15'W
09.37h had to break off the fight because of an approaching patrol vessel, U 39 dived

Not really an "battle" in my eyes :-)
