I decided investigate this problem myself. I used the legal documents in Russian and German languages which freely distributes embassy of Germany in Moscow.
I have attentively read the Constitution of Germany together with all amendments made after 1949. Unfortunately Constitution does not give the direct answer to my question. There is written only about "period of a defense". There is not written about use of the armed forces outside Germany, and about the obligations within NATO. NATO is not mentioned there.
Priority have the international obligations and international conventions of Germany. I have established that best priority has the convention "Two pluss Four" determining status of united Germany in 1990. In this the convention is written:
"United Germany will not apply the weapon, unless according to the constitution and Charter of the United Nations".
in German:
"das vereinte Deutschland keine seiner Waffen jemals einsetzen wird, es sei denn in Ubereinstimmung mit seiner Verfassung und der Charta der Vereinten Nationen".
Thus in frameworks of this convention the German Army can conduct battle actions not only in territory of the countries of NATO, but in any points of the world. However these actions should be carried out from the sanction of UN. According to rules of UN any country being the constant member of Council of safety the UN can forbid use of the armed forces of Germany outside territory of this country.
Within the framework of this contract NATO is not the subject of international law and the obligations of Germany within this organization after signing the convention "Two pluss Four" lose legal force.
I highly appreciate and respect peaceful policy of united Germany. I am sure that the law will be carried out strictly.
