since "ownership" and "holdership" are different things, lawyers suggest to consider the captured hardware as "on loan" by the opponent. After the war, the Peace Treties established the actual ownership of the above said hardware. This could be simple for the weaponry, which is always considered State property, but might became difficoult for private property, like a merchant ship or a Renaissance statue or a house or a car. Usually the defeated State pays some miserable price to his citizens for their losses while the winner one can afford more reasonable compensation.
How these matter were actually handled in the detail is still an unanswered question for many. The only sure thing is that wars are "produced" using up both the the blood and the wealth of the lower/middle class people.
