I have to disagree with you, once an enemy is in the water, he is Not a legitimate target anymore.
He is just another person, who try to save his live. It would be different, if this person try to kill his rescuer, or is involved in any other hostilities.Why do you think, Eck got executed??
But like I said before, different statues apply for the victors and the loosers!!
