<HTML>On the night 8 / 9 May 1945 in Berlin was signed the report about the unconditional surrender of Germany. From this point entire territory of Germany is occupied.
Regime of occupation is fixed in Hague (1899 and 1907) conventions about laws and customs of war. The authority of the occupied state ceases with the occupation, administrative control of territory is accomplished by a military command of occupation forces with the observance of the standards of international law. Military authorities publish in the occupied territory one-sided reports in the attitude of population and local authority and ensure their observance by the specific measures of coercion.

Allied occupation of Germany
Feb 1945 Yalta Conference agreed partition of Germany (x 4 = US, USSR, UK, France)
4 zones to have military administration
Jul-Aug 1945 Potsdam Conference: demilitarize, denazify, democratize Germany
Creation of central government prohibited
x 4 Allied Control Authority (ACA) to administer

The attempts of Doenitz to assume laws from the person of German government should be considered as clownery. He could similarly assume laws from the person of the nonexistent Roman Empire.
